Terms of Service

1. Acceptance of Terms

By accessing or using VariantLab ("the Service"), you agree to be bound by these Terms of Service. You must be at least 18 years of age to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information during registration
• Maintain only one account per person
• Keep your account credentials secure and confidential
• Accept responsibility for all activities that occur under your account

3. Mana Credits

VariantLab uses a credit system called "Mana" to access AI-powered features.

• Pricing: 1 Mana = $0.08 USD
• Refunds: All Mana purchases are final and non-refundable
• Expiration: Mana credits do not expire
• Transferability: Mana balances are non-transferable between accounts

4. Service Availability & API Failures

VariantLab relies on third-party AI model providers to deliver its core functionality. You acknowledge and agree that:

• The Service depends on the availability of specific AI models from external providers
• API calls may fail due to provider outages, network issues, rate limiting, or content filtering
• VariantLab is NOT responsible for Mana consumed during failed operations. Mana is deducted when API calls are made, regardless of whether the operation succeeds
• We make no guarantees of uptime, availability, or uninterrupted service
• The Service is provided on an "as-is" and "as-available" basis

5. Generated Content Ownership & Licensing

Regarding images and content you generate using the Service:

• You retain ownership of images you generate through the Service
• Generated images are commercial use friendly, subject to the Terms of Service of the underlying AI models used to create them
• It is your responsibility to review, understand, and comply with the Terms of Service of the AI models you use through VariantLab
• VariantLab does not claim ownership of any content you create

6. User Responsibilities

You understand and agree that:

• When using VariantLab, you are interacting with AI models on your own behalf
• VariantLab is an interface and tool that facilitates access to AI capabilities; we are not the AI provider
• You are solely responsible for all prompts you submit, content you create, and how you use the generated outputs
• You must ensure your use complies with all applicable laws and regulations, and the Terms of Service of the AI models you use

7. Prohibited Content & Conduct

You may not use the Service to create, upload, or distribute:

• Lewd, adult, NSFW, or sexually explicit content
• Content depicting minors in any inappropriate or exploitative manner
• Violent, hateful, discriminatory, or harassing content
• Content that infringes on copyrights, trademarks, or privacy rights of others
• Illegal content or content that facilitates illegal activities

Violation of these rules will result in immediate account termination without refund of any Mana balance.

8. Account Termination

VariantLab reserves the right to:

• Terminate your account immediately for violation of these Terms
• Terminate your account for any reason, at our sole discretion
• No refund of Mana credits will be provided upon account termination

9. Intellectual Property

The VariantLab name, logo, branding, and platform (excluding user-generated content) are the intellectual property of VariantLab and are protected by applicable intellectual property laws. You may not use our branding without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

• VariantLab is not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for how you use generated content downstream
• We are not responsible for your use of or prompts submitted to AI models

11. Indemnification

You agree to indemnify, defend, and hold harmless VariantLab and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
